Order Denying Plaintiff’s Motion for Specific Medical Treatment
Dawn Lane (Raleigh) recently obtained a favorable decision as to Plaintiff’s Motion to Compel Specific Medical Treatment in a claim wherein Plaintiff sustained an injury to her right ankle. Plaintiff’s treating physician recommended plaintiff undergo physical therapy. The physical therapy was authorized by defendants and the scheduling of physical therapy was assigned to Align Networks. Plaintiff requested that her physical therapy be scheduled at a specific physical therapy facility as it was closer to her work; however, defendants informed plaintiff that Align Networks would need to schedule the physical therapy with an “in-network” provider. Plaintiff filed a Motion for Specific Medical Treatment requesting the IC enter an Order directing defendants to pay for physical therapy at her chosen facility. Defendants responded to plaintiff’s motion and shortly thereafter the IC entered an Order stating that plaintiff’s Motion for Specific Medical Treatment and specifically that defendants be ordered to pay for out-of-network physical therapy was denied.
